CENTRE COUNTY, Pa (WJAC) — There is an update on the ongoing legal battle in the wake of the 2017 hazing death of former Penn State student Timothy Piazza.
While most of those originally charged have wrapped up their court cases, two defendants are still awaiting trial and prosecutors now say their pre-trial arguments should be "denied" by a judge.
Timothy Piazza died a few days after attending a fraternity pledge event at Penn State's Beta Theta Pi fraternity in 2017.
Investigators say Piazza consumed 18 alcoholic beverages at the event.
Two of those charged in the resulting court case were Brendan Young, who was the fraternity president at the time, and Daniel Casey, the vice president and pledge master.
But the pair has never gone to trial over ongoing appeals concerning evidence in the case.
Most recently, their appeals have focused on the recklessly endangering another person charges they're facing as they claim the prosecution's evidence doesn’t support those charges, and the evidence should be suppressed in their cases.
In the latest filing, prosecutors, the state attorney general’s office, disagrees strongly, saying "the defendants arguments establish no legal basis for suppressing the evidence.”
Casey and Young are due to go on trial in Centre County court in September, but a separate hearing is scheduled later this month on the pre-trial motion.
