Whalen was charged with promoting an obscene sexual performance by a child, a class D felony and possessing an obscene sexual performance by a child, a class E felony, after allegedly possessing a video featured a young girl's genitals and promoting it on a torrent site in late August, according to the complaint from the Westchester County District Attorney's Office.

The girl in the video appeared to be 8 to 10 years old, according to the complaint.

Whalen was arraigned in Yorktown Town Court and released on his own recognizance, according to the District Attorney's office.

The Yorktown School District said in a statement that Whalen has been placed on administrative leave and was not in school Tuesday. 

"We want to emphasize that the authorities have said at this point they are not aware of any involvement of district students," the district said. "The investigation is still active and unfolding. The education of our students, their security and emotional well-being remains our top priority."
